Subscription Program Terms

These Subscription Program Terms (these “Subscription Terms”) govern your participation in our Subscription Program (the “Program”) and include important terms regarding registering an Account, canceling and modifying your subscription, notifications for changes, and other terms regarding our Products. Except as otherwise provided below, these Subscription Terms are subject to, and all capitalized terms used in these Subscription Terms are provided in, our Terms of Service and Terms of Sale. If there is a conflict between these Subscription Terms and our Terms of Service, Terms of Sale, or any other terms or policies referenced in those terms, these Subscription Terms will govern with respect to your subscriptions and participation in the Program.

Please note that our Terms of Service include important information regarding your rights and obligations, as well as various conditions, limitations, and exclusions of liability and arbitration terms and a class action waiver in Sections 11 and 16. We encourage you to read our Terms of Service carefully before signing up for the Program as it affects your rights and obligations.

In addition, information you submit to us in connection with the Program is subject to our Privacy Notice. Please review our Privacy Notice carefully.

  1. Program Overview

You will receive 10% off retail pricing on our Site and free shipping for all Products to which you subscribe as part of the Program. The Program is available only for Products available on our Site or in our store on the “Shop” app that display a “subscribe & save” offer option, and is available for in-stock products only while supplies last. This offer cannot be applied to previous purchases or the purchase of gift cards. Wholesale orders and one-time orders are excluded. Void where prohibited by law. The Program and these Subscription Terms are subject to change, subject to the terms and conditions provided below.   1. Sign-Up

To start a subscription and participate in the Program, select a Product you would like to purchase on our Site or in our store on the Shop app. Then select “subscribe & save,” rather than selecting "one-time purchase." Once you select this option, you can change the frequency of your recurring order (our default is every 30 days, but we provide both longer and shorter options). Next, add the Product to your cart and go through the checkout process. Once you complete the checkout process, you will be successfully signed up for the Program with a Chomps subscription!

Subscriptions can be managed with the unique link that will be emailed to you upon subscribing (or via the Shop app for subscriptions initiated through the Shop app). For easy access, you may also create an Account, with a unique username and password. Note that to view your subscription, you will need to activate your Account. From your Account page, you can view your recurring order history. You can manage your subscription without a password using this special login link.

Third-party vendors (like Amazon and Thrive Market) may offer subscriptions to our Products. We do not manage such subscriptions and they are not part of the Program. We have no responsibility or liability for any subscription programs you may enroll in other than through our Site or our store on the Shop app. This includes third-party vendors accessible via the Shop app. The only subscriptions offered through the Shop app that we manage are those initiated from our store (i.e., from our direct product listings on the Shop app). We do not manage, and are not responsible for, any subscriptions that may be offered by third-party sellers of our Products on the Shop app.

  1. Orders and Auto-Renewals

When you purchase a Product as part of the Program you'll receive repeat deliveries of the Product you ordered based on the subscription frequency that you selected. Your payment details will be stored in accordance with our Privacy Notice and you'll only be charged for Products once they are shipped to you. For clarity, please note that:

  • Your subscription will continue until you cancel it.
  • Your credit or debit card, or payment account with a third party, will be charged a recurring amount based on the Products you subscribed to receive as part of the Program, including applicable tax, once such Products are shipped to you, unless you cancel or modify your subscription and participation in the Program. Product prices may change, subject to our notification obligations outlined below.
  1. Additional Discounts

From time to time we may offer additional discounts for our Products. Some discounts may be eligible to be added to your subscription discount, whereas other discounts may not be eligible and cannot be applied to Products for which you receive a subscription discount. Please review the terms of any discount carefully. If an additional eligible discount is available and you would like to add a discount to your subscribed Products, you must log into your Account, select an active subscription, scroll down to where you will find the "apply discount" button, enter the discount code, and click "apply discount." Any added discount will apply to your next recurring order only.

  1. Cancellation; Modification

You can cancel or modify your subscription and participation in the Program at any time through your Account. Once you're logged into your Account, you can cancel or modify your subscription:

  • On a desktop, by clicking the "Subscriptions" button on the left side of your screen and then “Manage this Subscription”; or
  • On a mobile device, by tapping the "Order History" dropdown and selecting "Manage Subscription."

From your Account page, you can also update your address or payment method, skip a shipment, swap Products, change your delivery frequency, or apply discount codes. If you cannot log into your Account, you can also cancel or modify your subscription by emailing our customer service team at team@chomps.com or by calling us at (833)-582-9010.

To avoid your next recurring charge after cancelling or modifying, you must have cancelled or modified your subscription by 11:59 pm (CT) on the day before your next recurring order is set to ship to you under your subscription.

Please note that we may cancel your subscription and participation in the Program if, after 3 attempts, we are unable to process your method of payment on file for any reason and we are unable to contact you. If we cancel your subscription, you may re-enroll in the Program by logging into your Account, resubscribing, and updating your payment information.

  1. Notification

While you have an active subscription, we will provide you with notice of any material changes to these Subscription Terms and the Program, which may be delivered through your Account or via any other contact information you have provided to us. In addition, we will provide you with an annual reminder with the following details regarding your subscription and participation in the Program:

  • The Products subject to your subscription.
  • The frequency and amount of charges associated with your subscription.
  • A link to these Subscription Terms, including its description of the means to cancel your subscription.

Each notification you receive from us will include a link to these Subscription Terms.

  1. Shipping; Returns

You will receive free shipping for all Products ordered as part of the Program within the United States, including in Hawaii, Alaska, and Puerto Rico. Products will ship according to the frequency you selected (e.g., every 30 days) and should arrive within 3-6 business days following shipping. You'll also receive an order confirmation email each time your subscription ships.

Our Terms of Sale, including our Return Policy, apply to any Products you order or may wish to return under these Subscription Terms. Please see our Terms of Sale and Return Policy for additional details.

  1. Out of Stock and Discontinued Products

While we are usually able to keep subscribed Products in stock at all times, there may be times when subscribed Products are unavailable. If we know that subscribed Products are out of stock or are going to be more than 30 days late, we will provide you with a notification and an option to either cancel or substitute those Products for other Products. Either option will apply only to that particular shipment and will not apply to any future shipment. As noted above, you will only be charged once a Product ships. Accordingly, you won’t be charged if we run out of stock of any Product, unless you select a substitute Product, or we are able to restock the Product you subscribed to receive, and we ship the relevant Product to you.

If we discontinue a Product that you subscribed to receive as part of the Program, we will notify you as described in Section 6 above to inform you of the change and to provide you with an option to cancel or substitute the Products you subscribed to receive. Any substitution will apply to all future shipments unless and until you change your subscribed Products again.
